The user shared several posts on Instagram comparing Israeli actions to Nazi methods, including a split image showing the Israeli flag alongside the Nazi party flag with a partially visible swastika, and another depicting a wall bearing a Star of David containing a swastika with soldiers firing into a walled-off area where blood flowed beneath. The posts included hashtags such as #freepalestine and #gazaunderattack, and featured a table comparing Nazi actions to Israeli conduct in the conflict, according to the legal website beck online.

Legal reasoning and acquittal

The court ruled that the criminal offense of using symbols of unconstitutional organizations does not apply when such symbols are employed to sharply criticize Israel's methods while clearly condemning or distancing oneself from Nazi-era injustices. Citing the user's right to freedom of speech, the Zweibrücken court overturned the €2,400 fine imposed by a lower court in Ludwigshafen, cautioning against interpreting the statute too broadly in light of constitutional protections for expression.

The Ludwigshafen court had initially convicted the woman of using symbols of unconstitutional organizations and ordered her to pay the €2,400 penalty. On appeal, the higher regional court acquitted her of all wrongdoing in the ruling reported earlier this week by the legal website beck online.
