Poland's Sejm passed legislation with 231 votes in favor to impose a windfall tax on fuel companies including Orlen, implementing EU rules targeting extraordinary profits from the energy crisis while opposition lawmakers warned the measure could deter investment.

Poland's lower house of parliament on Friday approved government legislation introducing a windfall tax on fuel companies including state-controlled energy giant Orlen, capturing extraordinary profits generated during periods of market disruption following Russia's invasion of Ukraine.

Parliamentary passage

The bill passed the Sejm with 231 votes in favor, 201 against and one abstention. It will now proceed to the Senate for consideration before reaching President Karol Nawrocki for final signature.

The legislation forms part of Warsaw's efforts to implement European Union rules requiring member states to levy temporary contributions on fossil fuel companies. The measures target firms that benefited from unusually high profits during the energy crisis triggered by the war in Ukraine.

Government rationale

Government supporters said energy firms recording exceptional earnings during the period should contribute more to public finances and measures designed to cushion consumers from the effects of high energy prices. The tax targets profits deemed excessive during market volatility.

Investment concerns

Opposition lawmakers warned that additional taxation could discourage investment in the energy sector and reduce the competitiveness of Polish companies. Critics contend that the levy risks undermining capital flows into domestic energy infrastructure at a critical moment.

Orlen's role in the economy has become a recurring point of contention between the government and opposition. Critics of the previous Law and Justice administration accused the company of using pricing policies for political purposes — allegations rejected by former executives. If approved by the Senate and signed into law, the measure would add Poland to a growing list of European countries that have imposed special levies on energy companies in response to windfall gains.
